A "breach of an implied contract." Tricky at best, murky and muddy at worst.
Just a quick comment on it…
I get what the plaintiffs are trying to do but the tricky/murky part to me is personnel (based on ideas for reality shows). For example, Nosfer, Learjet, and Stephen come up with a show called "Demon Destroyers!" in which they find, face and ultimately destroy demons. It is turned down. A year later, Kate Beckinsale, Heather Graham and myself come up with a show called "Demon Destructo!" in which we do essentially the same thing. Do the three guys get payment for the idea for their show (which wasn't green-lit) or just by involving different personnel is the second show different enough to be called its own?
It's a hard call, especially because many of the reality shows aren't based on the "idea" or the premise, it's based on the people involved.
I have a feeling this case is going to get tossed…
